The county clerk performs the duties assigned by the Texas Constitution as registrar, recorder and custodian of all court pleadings, instruments and papers that are part of any legal cause of action in the county courts, click here for more information.

  • Records Filing Fees and Requirements

    Photo I.D. is required per Texas Local Government Code Section 191.010 (b)(c)

    • (b) A county clerk may require a person presenting a document in person for filing in real property records to present a photo identification to the clerk. The clerk may copy the photo identification or record information from the photo identification. The clerk shall copy the photo identification or record information from the photo identification. The clerk may not charge a person a fee to copy or record the information from a photo identification. 
    • (c) Information copied or recorded from the photo identification is confidential.  

    The Mason County Clerk and Staff will not conduct property searches that are not authorized by statute.

    We will retrieve records from provided specific information. We will provide copies as requested and payment received.

    The record search authorized by statute is Federal Tax Liens:     TX Property Code 14.004(d)

    Attorney General Opinion WW-607 (1959) the summary states the following:

    “The County Clerk has no duty to search the records under his control and guarantee the correctness thereof.”

    The Error and Omissions Insurance of the County Clerk only covers actions of the County Clerk and her staff, which are statutorily required duties. Therefore, it is in the best interest of the County, as well as the Clerk individually, to refrain from performing any action (including records searches) which is not legally required.

    We offer a public search computer in the office during our normal business hours:

    Monday through Friday, 8:00 a.m. – 3:30 p.m.

  • Hours for obtaining a Marriage License are

    Monday - Friday 8:00 A.M.-3:00 P.M. 

    Marriage License: $81.00; Informal Marriage License: $46.00;

    Certified copy of Marriage License: $7.00

    You must apply for a Marriage License 72 hours prior to the time you wish to be married. The Marriage License is valid for 90 days after issuance.

    Both parties must:

    • be in attendance to complete the Marriage License Application;

    • must be over 18 years old;

    • must provide a current Driver's License or Government issued photo ID;

    • must know the City and County in which they were born; and

    • must know their Social Security number.

     

    Name Change Kits

  • Applications for Assumed Names/DBAs will need to be completed in our office. The application fee is $23.00. All owners will need to be present at the time of the application.
  •   It is $26.00 for cattle and $26.00 for horses for only one location.  You have to complete a separate application for only these two species of animals and if you have more than one location it is an additional $26.00 per location.  Swine, sheep & goats may be entered on either type of application. 

    As long as you have the application Notarized you do not have to come into the clerk’s office you can mail in the application with the fee.  Do not email it in we have to have the original.  We will not accept a renewal application before August 31st 2021.  Your brand will remain yours until the end of February 2022 and then it is open to anyone, unless a new application is completed.

  • Please note the following:

      • If your birth occurred outside of Mason County, but within the State of Texas, you will be issued an Abstract Record which is still a certified legal document. This will not be acceptable for passport requests.
      • If you were not born within the State of Texas we are not able to access your birth certificate. You will need to contact the state where you were born.
      • Death Records are available only for decedents who pass within the Mason County limits.

       

      Applications are available in our office Monday - Friday 8:00am-3:30pm. Please be sure to provide a valid photo Id!

      If you care needing your Birth Certificate you can request one directly from the Texas Department of State Health in person at the DSHS - Central Campus, 1100 West 49th Street, Austin, Texas or online. For passports you will want to make sure you are order the LONG FORM.

  • THERE ARE NO ACTIVE COUNTY JURY SUMMONS AT THIS TIME. PLEASE BE SURE TO ALSO CHECK OUR MASON COUNTY DISTRICT CLERK PAGE REGARDING JURY IN MASON COUNTY DISTRICT COURT. 

    Please be sure you have completed and returned your Juror Questionnaire to the Mason County Clerk's Office, within 3 days of receiving your summons!

    You must report for jury service unless you: (1) claim an exemption; or (2) are disqualified; or (3) request to postpone your service.

    To claim an Exemption or Disqualification, be sure to complete the back of your summons, sign, date and return to the Mason County Clerk's Office, within 3 days of receiving your summons. To request to postpone your service please call the Mason County Clerk's office for further instruction. 

    PROPER CLOTHING REQUIREDAll persons entering the courtroom should be dressed in clothing reasonably befitting the dignity and solemnity of the court proceedings. NO shorts, jeans with holes, crop tops or showing midriffs, sleeveless shirts, flip flops, or hats are permitted.

    CELL PHONE USE IS PROHIBITED

    RIGHT TO REEMPLOYMENT:
    An employer may NOT discharge, threaten to discharge, intimidate, or coerce any permanent employee because the employee serves as a juror, or for the employee's attendance or scheduled attendance in connection with the service, in any court in the United State. (Civil Practice and Remedies Code, Section 122.001).

    FAILURE TO ANSER SUMMONS:
    In addition to any criminal penalty prescribed by law, a person who fails to comply with this summons, or who knowingly provides false information in a request for an exemption or to be excused from jury service is subject to contempt action punishable by a fine of not less than $100 nor more than $1000 (Government Code, Section 62.0141).
